1. Subject

Forge de Laguiole SAS, Route d’Aubrac, BP9, 12210 Laguiole, France, registered in the trade and company register of Rodez under RCS no. 340 802 552 00026 and VAT No. FR23 340 802 552 (hereinafter referred to as “Forge de Laguiole” or “we”, “us” or the like) operates the website “forge-de-laguiole.com” and the related online shop (hereinafter collectively referred to as “Online Services”), through which you can access information and order products and/or services.

These General Terms and Conditions (hereinafter referred to as “GTC”), together with your order, form the contract between you and us for the ordering of products and/or services in our online shop and for the use of the Online Services. By clicking the checkbox “I accept the General Terms and Conditions.” you declare to have read, understood and accepted the GTC without reservation.

You declare that you are at least 18 years old or that you have the permission of your legal representative to place an order in our online shop. If you are entering into the contract on behalf of your employer or another company, you represent and warrant that you are authorized to represent that company and to enter into the contract with us, including these GTC, on behalf of that company. We may assume that you have the appropriate authorization, regardless of internal regulations and/or circumstances of that company and entries in the commercial/trade register entries and without further verification of such authorization. When we refer to “you”, “your” or the like in these GTC, this always also refers to the company on behalf of which you are acting.

2. Conclusion of the contract

The presentation of products and services in the online shop is not a legally binding offer, but merely represents a non-binding online catalogue or a non-binding request to order the relevant products and/or services in the online shop. If you place a product or service in the “shopping cart”, this is not yet considered a binding order. A binding order for the products and/or services contained in the shopping cart is only placed when you click on the “Send Order” button on the checkout page. The contract is concluded with the transmission of the order confirmation in the form of an e-mail.

3. Products and order

Before placing your order, you can inform yourself in the online shop about all the features of the product you want to order. Please note that there may be differences between the product you have ordered and the product shown in the online shop (especially with regard to the handles of knives made of natural material). Accordingly, the photos of the products are not binding.

Following your order, you will receive an order confirmation in the form of an e-mail, in which the components of the order are confirmed. Accordingly, you have to provide a valid e-mail address.

You agree that following an order we may inform you about our own offers and about offers from partners that may be of interest to you. You also agree that we may send you news, offers and other information via various communication channels (e.g. via e-mail or SMS). You can unsubscribe from these services at any time.

4. Delivery

The delivery will be made to the delivery address you have provided. The delivery to P.O. box addresses is excluded. The following delivery conditions apply, whereby the respective delivery conditions stated in the online shop take precedence in the event of any deviations:

4.1 Deliveries to France and Monaco

Delivery method:

Orders are shipped by Chronopost. You can choose between the following two delivery methods:

● Delivery to your home (home address)

● Delivery outside the home address “My dealer” in a relay package (against signature)

Shipping costs:

The shipping costs are calculated according to the weight of the parcel and displayed on the checkout page.

For orders with a value of more than EUR 600.00 incl. VAT the shipping costs are waived.

Delivery time: *

For products that are in stock, the delivery time is usually between 48 and 72 hours on working days, calculated from the date of dispatch. Please note that for products that still have to be manufactured, the time until the products are dispatched is 3 to 4 weeks.    

4.2 Deliveries to EU countries (except France and Monaco)

Delivery method:

Orders are shipped by DHL. The delivery method is :

Shipping costs:

The shipping costs are calculated according to the weight of the parcel and displayed on the checkout page.

For orders with a value of more than EUR 1’000.00 incl. VAT the shipping costs are waived.

Delivery time: *

For products that are in stock, the delivery time is usually between 48 and 72 hours on working days, calculated from the date of dispatch and without customs clearance. Please note that for products that still have to be manufactured, the time until the products are dispatched is 3 to 4 weeks.

4.3 Deliveries to countries outside the EU

Delivery method:

Orders are shipped by DHL. The delivery method is :

Shipping costs:

The shipping costs are calculated according to the weight of the parcel and the country of destination and displayed on the checkout page.

Please note that for deliveries to countries outside the EU, you will be invoiced separately for the local VAT of the respective country of delivery and for any possible additional taxes, customs duties and fees.

Delivery time: *

For products that are in stock, the delivery time is usually 7 days, calculated from the date of dispatch and without customs clearance. Please note that for products that still have to be manufactured, the time until the products are dispatched is 3 to 4 weeks.

* The delivery times stated here apply under normal service conditions. The actual delivery times may differ from the information given here (e.g. in case of strikes, problems with postal delivery, etc.). All information is provided without guarantee. Compensation for damages or further claims due to delayed delivery are excluded.

As a general rule, ordered products which are in stock are dispatched by us on the day after the payment has been successfully processed or on the date stated in the order confirmation. For payments made on Friday, Saturday or Sunday, the products are usually shipped the following Monday or on the date indicated in the order confirmation.

4.4 Damaged parcels

If the parcel is damaged, torn or opened at the time of delivery, you must check the condition of the products. If the products are damaged, you must refuse delivery of the parcel and indicate a reservation on the delivery note.

4.5 Return of parcels

In the event of a return of the parcel (e.g. due to a wrong address or a failure to pick up the package), the shipping service provider will return the parcel to us. In this case you will be informed by us. After you have paid a lump-sum shipping fee, we can send the parcel again.

4.6 Loss of parcels

In case of loss of a parcel (e.g. on the part of the shipping provider) we will resend the ordered products to you. If you are requested to do so by us, you will be required to provide a sworn statement confirming that you have not received the parcel and undertaking to refuse the original (unreceived) shipment if it is delivered after all. This document is required to make a complaint or report to the shipping company and possibly the police.

5. Availability

All products and services that are displayed as available in the online shop are usually also available. Should this not be the case in exceptional cases and your order cannot be executed or cannot be executed in time, you will be informed by us by e-mail or telephone. If your order definitely cannot be executed, you have the following options:

● Refund of the amount paid

● Issue of a gift voucher for the amount paid

● Delivery of another product of your choice with the same value

Further claims such as compensation for damages are excluded.

Temporarily unavailable products cannot be reserved and there will be no subsequent delivery of such products. Please place a new order as soon as the products are shown as available again in the online shop or contact us directly by e-mail at contact@forge-de-laguiole.com to check availability.

6. Prices and payment

The prices displayed in the online shop in Euro (EUR) at the time of the order are applicable. The displayed prices do not include any shipping costs.

Depending on the country of delivery chosen, the prices include French VAT of 20% and other taxes (EU countries) or exclude VAT and other taxes (countries outside the EU). For deliveries to countries outside the EU, you will be invoiced separately for the local VAT of the country of delivery concerned and any possible additional taxes, customs duties and fees (e.g. by the shipping provider or by local authorities of the country concerned). As the importer of the product, you are responsible for these additional taxes, customs duties and fees. Any responsibility and liability on our part is excluded.

We reserve the right to change the prices at any time. Furthermore, incorrect price information is reserved.

The payment methods displayed in the online shop are available. If your online payment fails or is not accepted, we are not obliged to further process your order. No payment periods are granted. The products will only be shipped when the corresponding payment has been processed.

7. Right of withdrawal

If you are a resident of the EU, you have a right of withdrawal of 14 days, calculated from the effective receipt of the products ordered in our online shop, without having to give reasons for the withdrawal. Products that were manufactured according to customer specifications (e.g. personalized products) are excluded from the right of withdrawal.

You are obliged to send the products to the above-mentioned address within 14 days after you have informed us of the withdrawal. The return shipment is at your expense. The returned products must be new, complete, unused, in their original undamaged packaging and accompanied by the invoice. Returned products that are damaged or dirty will not be accepted and will be returned to you without refund.

If the above conditions of withdrawal are met, we will refund the full amount paid for the products ordered and the shipping costs. If the products have been damaged or dirtied by you and thus reduced in value, an incomplete refund may be issued. If you return only a part of the products ordered, we will not refund the original shipping costs. In addition, the local VAT of the country of delivery and any possible additional taxes, customs duties and fees charged to you separately are non-refundable. Please also note that we do not process export documents in connection with the return of products.

Please note the following deadlines for refunds:

● at the latest 14 days after we have received the products back from you or

● at the latest 14 days after you have provided written proof that the products have been returned, or

● if no products have been shipped by us or delivered to you yet, 14 days after the day on which you have informed us of the withdrawal.

The refund will be made using the same payment method you used to place your order, unless otherwise expressly agreed. You will not be charged for any refund.

If you withdraw your order after we have already shipped the products to you, we may withhold the refund until we have received the products or you have provided us with written proof that the products have been returned. If we do not receive the products concerned, we may arrange for collection at your expense.

The return as well as the exchange or refund of products purchased in the online shop in retail stores is excluded.

8. Discount codes and vouchers

Some discount codes and vouchers are limited to certain products, services or categories of products or services and/or are linked to a minimum order value. Discount codes and vouchers cannot be redeemed more than once in the same order and cannot usually be combined with other discount codes or vouchers. The respective provisions of the discount code or voucher apply. An exchange of discount codes or vouchers for cash is excluded.

The following additional conditions apply to gift vouchers: Gift vouchers are redeemable once and are not linked to a minimum order value. If the value of a gift voucher exceeds the value of the product purchased, the remaining amount is forfeited.

9. Warranty

We provide a warranty of at least 24 months on all our products. The products must be carefully checked upon receipt and any defects found (e.g. material or manufacturer’s defects or damage) must be reported to us immediately. Please send the defective or damaged products to the above address. The return shipment is at your expense.

10. Liability

We are liable for damages caused intentionally and by gross negligence as well as for personal injury. Any further liability is, as far as legally permissible, excluded. In particular, we assume no liability in cases of force majeure or for damages that are attributable to you or for which you are responsible. In cases of force majeure, we are furthermore released from our obligation to perform.

11. Use of the Online Services

The following provisions govern the use of the Online Services as well as their contents and applications. In the event of a breach of these terms of use, we reserve the right to block your customer account immediately, without prior notice and without compensation.

11.1 Customer account

In order to be able to use the Online Services and the services offered through them, you have to create a customer account (registration). The information required for this must be complete and correct.

You are responsible for the access data for the customer account (login) and the corresponding passwords. These data must be stored carefully, protected from unauthorized access by third parties and not passed on to unauthorized third parties. Notify us immediately if you lose your data. Any liability is excluded.

You are obliged to keep your billing, delivery and e-mail address as well as any other details in your customer account up to date at all times. The e-mail address you have entered and stored in the customer account is the primary delivery address. Correspondingly, we will usually send information relevant to the contract (e.g. invoices, changes to services and/or contractual terms, etc.) to this e-mail address or make this information available to you in another suitable way (e.g. in the customer account). Information transmitted or made available in this way is deemed to have been legally delivered.

11.2 Warranty and liability

We create and maintain the Online Services as well as their contents and applications with the greatest possible care. However, we do not assume any warranty or liability for the correctness, completeness and actuality of the contents as well as for the availability and the correct functioning of the Online Services and their applications. In particular, errors in the description of the services offered and their prices are reserved.

We also accept no liability for the use of the Online Services and their contents and applications. The information and opinions on our Online Services are not intended to be comprehensive or conclusive statements on the subject in question, do not constitute advice and must therefore not be regarded as a substitute for specific advice on a specific individual case. In addition, they may only represent the opinion of the respective author, not of Forge de Laguiole.

Further, the liability for the contents as well as for the availability and correct functioning of the websites and online portals of third parties to which reference is made via links or in any other way or which refer to the Online Services is excluded. The contents of the websites and online portals of third parties is third-party content over which we have no control and for which we are not responsible.

We also accept no liability for damage caused by viruses, hacker attacks or other manipulations of your device by third parties. No liability is assumed for the security of the transmission of data via the Internet.

11.3 Intellectual property

All intellectual property in the contents of the Online Services and its applications (texts, trademarks, images, videos, layout, etc.) is with us or the respective authorized third parties. All rights reserved. Use of any kind without prior explicit consent is prohibited. It is permitted to cite using correct references and to set links to the Online Services.

11.4 Privacy

The “Privacy & Cookie Policy” explains how we collect and process personal data in connection with the operation and use of the Online Services and their applications. 12. Further provisions

The transfer of the contract or the assignment or transfer of rights, obligations or claims arising therefrom requires our prior written consent.

Amendments and supplements to the contract, including these GTC and any subsidiary agreements must be made in writing. This also applies to any amendment of this written form requirement.

These GTC may be changed at any time without prior notice and without stating reasons with effect for the future. The then current version published in the Online Services applies.

If a provision of the contract, including these GTC or any subsidiary agreements, is invalid or ineffective in whole or in part, the validity and effectiveness of the remaining provisions shall remain unaffected. In this case, the parties undertake to replace the invalid or ineffective provision by a provision that comes closest to the economic intent of the parties. The same shall also apply in the event of contractual omissions.

13. Applicable law and place of jurisdiction

The contractual relationship between you and us is governed by French law. In the event of a dispute, the courts in France shall have exclusive jurisdiction. Mandatory places of jurisdiction are reserved.
